SALES AND SHIPPING
This Sales and Shipping Policy describes the sales and shipping policy of Auxor Cellars (“we,” “us,” or “AC”).
Your order may be subject to sales tax, which will be charged when you place your order. All orders are processed at, and shipped from, our fulfillment warehouse in Fairfield, California (The Packaging Co, LLC). We ship via Fed Ex ground and air and our shipping prices include packaging materials. Unless you live on the West Coast, we recommend that you not select “Ground Shipping ” as your shipping method, as weather conditions and longer delivery times may result in the spoilage of your order. By placing an order with AC, you authorize AC to act on your behalf to engage a common carrier to deliver the items in your order to an address specified by you, except as provided below. All orders are FOB The Packaging Co, LLC, meaning that when your order is picked up at The Packaging Co, LLC by the common carrier for delivery, the items in your order become your responsibility. To protect your order, you may purchase insurance for an additional charge. AC is not responsible for, and will not replace, any item that is damaged during shipment, including, but not limited to, by reason of extreme weather, delay in delivery, or otherwise.
As further described in the Terms and Conditions, AC does not sell wine (or any other alcoholic beverage) to persons under the age of 21. All shipments of wine from AC are sent with an “Adult Signature Required” sticker, and the common carrier that delivers our wine is required to ask and check for identification upon delivery. This means that a person over the age of 21 must be present at the time of delivery.
If your order is returned to us by the common carrier (e.g., due to unsuccessful delivery after three attempts), you will be responsible for any following attempts to re-ship the wine to you. These amounts must be paid before your order is re-shipped and AC may, but need not, send you an invoice for such amounts.
We are not permitted by law to ship wine to certain states and will not ship wine to addresses of such states or where AC, in its sole discretion, believes that such shipment may subject AC to legal action or other harm. If you live in a state to which direct shipment of wine violates the law, we will inform you of this fact when you place your order or as soon as reasonably possible thereafter, and we will not process your order. During business hours, your orders are immediately packaged and scheduled for delivery, but may be delayed until ideal weather conditions for shipment arise. The result may be that your shipment does not go out the day that you place an order. You will receive tracking information to the email provided with the order when your wines are ready to be shipped. Generally, we will attempt to ship your wines in the Fall shortly after our annual offer is sent and your order is placed. These shipments are always WEATHER PERMITTING. RETURNS
We strive to provide our customers with the highest quality products and service. Your satisfaction is our top priority. If you are dissatisfied with your order, please contact us within seven days of the date of your order for customer care assistance.
All wines sold are maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper and we cannot be responsible for improper storage after it has been delivered. Therefore, once your wine order has been picked up by the common carrier for delivery, the wine becomes your responsibility. We are not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. We also cannot accept returns for the following reasons: wines that do not coincide with personal tastes, wines that have been adversely affected by customer storage, and wines that have been otherwise damaged as a result of any other adverse condition occurring while the wines were in the your care.
If wine is shipped back, we will refund your credit card for the cost of the wine less shipping and handling once it is received. If the original shipment was damaged or flawed you will receive a full refund, including shipping and handling charges.
